By visiting our website, contacting us, or registering for a trip, you agree to the following Terms and Conditions, which outline the rights and responsibilities of both participants and Prism Adventures.
1. Trip Information and Services
All trip details, itineraries, and prices displayed on our website or communicated via email or social media are subject to change. While we strive to maintain accurate and updated information, adjustments may occur due to weather, logistical considerations, local regulations, or availability of partners.
Prism Adventures reserves the right to modify itineraries, accommodations, or activities as necessary to ensure participant safety and the overall quality of the experience.
2. Bookings and Payments
A non-refundable deposit is required to confirm participation in any trip.
The remaining balance must be paid by the deadline specified in the trip confirmation email or payment plan agreement.
Failure to complete payment by the due date may result in loss of the participant’s spot without refund of the deposit.
All payments must be made via bank transfer to the official Prism Adventures account, unless otherwise stated.
3. Cancellations and Refunds
Our cancellation policy is as follows:
Deposits are strictly non-refundable and non-transferable.
Cancellations made 4 weeks or more before the trip start date: eligible for up to a 50% refund of the total trip cost, excluding the deposit, and subject to third-party provider policies.
Cancellations made less than 4 weeks before the trip start date: no refunds will be issued.
Exceptions:
In the event of the death of an immediate family member (father, mother, spouse, child, or immediate sibling) within 4 weeks of the trip, a refund may be considered, excluding the non-refundable deposit. Official documentation will be required.
In the case of severe illness or injury within 4 weeks prior to the trip that prevents safe participation, amounts paid beyond the deposit may be credited toward another Prism Adventures trip within 12 months. Pre-existing conditions known to the participant are not considered valid grounds for exception.
4. Participant Responsibilities
Participants are expected to:
Provide accurate personal and medical information during registration.
Ensure they meet the physical and health requirements of the trip.
Hold valid travel documents, including passports, visas, and insurance where applicable.
Follow all safety instructions provided by Prism Adventures staff and local guides.
Behave respectfully and professionally toward other participants, guides, and local communities.
Prism Adventures reserves the right to remove any participant who displays disrespectful, discriminatory, or disruptive behavior without issuing a refund.
5. Health and Fitness
Participants must ensure they are in good health and physically capable of participating in the selected trip.
Prism Adventures may request additional medical information for certain high-intensity trips.
Participants are responsible for bringing any required medication and informing the guides of any relevant health conditions or allergies.
6. Travel Documents and Visas
Each participant is responsible for obtaining and carrying valid passports, visas, and any other required travel documents.
Prism Adventures is not liable for delays, denied entry, or missed portions of the trip resulting from incomplete or invalid documentation.
7. Third-Party Providers
Prism Adventures works closely with trusted third-party partners, including hotels, transportation providers, and local activity operators, to deliver a seamless travel experience.
While these partners operate under their own terms, Prism Adventures remains the main point of contact for all trip-related matters.
If an issue arises due to the actions or omissions of a third-party provider, Prism Adventures will act on behalf of the participant to resolve the situation to the best of its ability.
8. Force Majeure
Prism Adventures shall not be held liable or responsible for delays, cancellations, or alterations to the trip resulting from events beyond its reasonable control.
These include but are not limited to natural disasters, extreme weather conditions, acts of government, war, strikes, pandemics, border closures, civil unrest, or other events deemed “force majeure.”
In such cases, Prism Adventures will make reasonable efforts to reschedule or adjust the trip, but refunds or credits are provided at the sole discretion of the company and subject to third-party policies.
9. Limitation of Liability
By participating in any Prism Adventures trip, the participant acknowledges and accepts that travel and adventure activities carry inherent risks.
Prism Adventures shall not be liable for any personal injury, loss, damage, delay, or expense arising from causes beyond its control, including acts of nature, negligence of third parties, or participant actions.
Participants agree to release Prism Adventures from any claims related to such incidents, except in cases of proven gross negligence or willful misconduct by the company.
10. Photography and Media
Prism Adventures may document trips through photos and videos for promotional and community purposes.
Before doing so, participants will be asked for their consent to appear in such content.
If a participant agrees, Prism Adventures may use their photos or videos across its website, social media, and marketing campaigns.
If a participant declines, their privacy will be fully respected, and their image will not be included in any public or promotional materials.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kuwait.
Any disputes, claims, or actions arising out of or related to these Terms or the services provided by Prism Adventures shall be submitted to the exclusive jurisdiction of the courts of Kuwait.
