By visiting our website, contacting us, or registering for a trip, you agree to the following Terms and Conditions, which outline the rights and responsibilities of both participants and Prism Adventures.

These Terms and Conditions are incorporated into the Participant Waiver and Agreement signed at the time of booking.

1. DEFINITIONS

“Prism Adventures” refers to Prism Adventures and its representatives, guides, and staff. “Trip” refers to any tour, expedition, trek, or activity organized by Prism Adventures. “Participant” refers to any person who books or takes part in a Trip. “Local Operator” refers to third-party ground operators, accommodation providers, transport companies, or activity providers engaged to deliver services during the Trip. “Deposit” refers to the non-refundable booking deposit of 275 KWD per person.

2. COMMUNITY GUIDELINES AND CODE OF CONDUCT

All Participants are expected to treat fellow travelers, guides, local communities, and Prism Adventures staff with respect. Prism Adventures reserves the right to remove any Participant from a Trip at any time if their behavior is deemed harmful, disruptive, or disrespectful to others. No refund will be issued in such circumstances.

3. PUNCTUALITY

Participants are responsible for arriving on time for all scheduled departures, activities, and transfers. Prism Adventures will not delay group departures for late individuals and is not liable for any costs or losses arising from a Participant’s failure to be on time.

4. ASSUMPTION OF RISK

Adventure travel involves inherent risks including, but not limited to, physical injury, illness, accidents, extreme weather, altitude-related conditions, equipment failure, and acts of nature. By booking a Trip, you acknowledge and accept these risks voluntarily. Prism Adventures takes all reasonable precautions, but cannot eliminate risk entirely.

5. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

To the maximum extent permitted by applicable law, Participants release Prism Adventures, its directors, guides, staff, and agents from any and all claims, liabilities, damages, or losses arising from participation in a Trip, including injury, illness, loss of property, or death, whether caused by negligence or otherwise. This release is a condition of booking.

6. INDEMNIFICATION

Participants agree to indemnify and hold harmless Prism Adventures, its directors, guides, staff, and agents against any claims, costs, or liabilities brought by third parties arising from the Participant’s conduct or actions during a Trip.

7. PHYSICAL FITNESS AND HEALTH DISCLOSURE

Participants are responsible for assessing their own fitness and health before booking. By confirming your booking, you represent that you are in suitable physical condition for the Trip selected. Prism Adventures reserves the right to exclude any Participant from a Trip or activity if, in our reasonable judgment, participation poses a risk to themselves or others. No refund will be issued in such circumstances. If you have any medical conditions, take prescription medications, or have any concerns about your fitness for the Trip, you must disclose this to us before booking.

8. TRAVEL INSURANCE

Travel insurance is mandatory for all Participants on all Prism Adventures trips.

Your policy must be active before your trip begins and must cover, at minimum:

• Emergency medical treatment

• Medical evacuation and repatriation

• Trip interruption

• Trip cancellation due to personal injury or family bereavement

Prism Adventures will request proof of insurance before departure. We are not responsible for any costs or losses that would have been covered by adequate travel insurance.

9. LOCAL OPERATORS AND THIRD-PARTY PROVIDERS

Prism Adventures works with carefully selected local operators and third-party providers to deliver accommodation, transport, and activities. These providers operate under their own terms and conditions. Prism Adventures is not liable for the acts, omissions, negligence, or failure of any third-party provider. In the event of a claim arising from third-party services, Prism Adventures will cooperate fully and provide any documentation to support the claim, but the claim must be pursued directly against the third party and through your travel insurer.

10. CANCELLATION POLICY

By the Participant:

All cancellations must be submitted in writing to Prism Adventures.

The Deposit of 275 KWD per person is non-refundable under all circumstances.

Refunds beyond the Deposit are calculated based on the date written notice of cancellation is received:

• 8 weeks or more before departure: Full refund of amounts paid, minus the Deposit

• 5 to 8 weeks before departure: Refund of up to 50% of amounts paid beyond the Deposit, depending on costs already incurred by Prism Adventures

• Less than 5 weeks before departure: No refund

These terms apply regardless of the reason for cancellation, including personal injury, illness, or family bereavement. Participants are strongly advised to hold travel insurance that covers cancellation for these reasons. Prism Adventures will provide documentation to support any insurance claim.

By Prism Adventures:

If Prism Adventures cancels a Trip for reasons other than Force Majeure, Participants will receive a full refund of all amounts paid. Prism Adventures is not liable for any additional costs, including flights or accommodation, booked independently.

11. FORCE MAJEURE AND ARMED CONFLICT

Prism Adventures is not liable for any failure to perform, cancellation, or modification of a Trip resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, extreme weather events, acts of God, pandemics, government restrictions, civil unrest, armed conflict, or other events that make the Trip impossible or unsafe to operate.

In such circumstances, Prism Adventures will make every reasonable effort to recover costs paid to Local Operators and third-party providers. Any amounts successfully recovered will be passed through to Participants on a pro-rata basis. We cannot guarantee any refund where third-party providers do not return funds to us.

No future credit, alternative trip, or guaranteed refund is offered under Force Majeure circumstances. Participants are strongly advised to hold travel insurance covering Force Majeure events.

12. TRAVEL DOCUMENTS AND FLIGHTS

Participants are solely responsible for ensuring they hold valid passports, visas, and any other travel documents required for the countries visited. Prism Adventures is not liable for any costs, losses, or inability to travel arising from inadequate documentation. Flights are the sole responsibility of the Participant. Prism Adventures does not book or manage flights and is not liable for any flight-related issues, changes, or cancellations.

13. PHOTOGRAPHY AND MARKETING CONSENT

Prism Adventures may photograph or film Participants during trips for use in marketing materials, social media, and promotional content. By booking, you consent to this use. If you do not wish to appear in any marketing materials, you must notify Prism Adventures in writing before the Trip begins.

14. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of Kuwait. Any dispute arising from or related to these terms or a Trip shall be subject to the exclusive jurisdiction of the courts of Kuwait.

15. SEVERABILITY

If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. ENTIRE AGREEMENT

These Terms and Conditions, together with the Participant Waiver and Agreement signed at the time of booking and any trip-specific documentation provided, constitute the entire agreement between Prism Adventures and the Participant. They supersede all prior representations, understandings, or agreements.

17. ACKNOWLEDGMENT

By completing a booking with Prism Adventures, you confirm that you have read, understood, and agreed to these Terms and Conditions in full, and that you are booking voluntarily and with full awareness of the nature of the Trip.
